1. Overview

These SMS Terms & Conditions (“SMS Terms”) govern text messages (SMS and MMS) sent and received through the MaLuce platform operated by MaLuce LLC (“MaLuce,” “we,” “us”). They apply both to businesses that use MaLuce to communicate with their contacts (“Customers”) and to the individuals who exchange messages with those Customers (“Recipients”). By opting in to receive text messages or by using the messaging features of the Services, you agree to these SMS Terms.

2. Program description

MaLuce provides a shared inbox that lets businesses send and receive SMS/MMS from their own phone numbers, including transactional messages (such as appointment confirmations, reminders, support replies, and account notifications) and, where consent has been obtained, informational or promotional messages. The exact nature, content, and purpose of any given messaging program are determined by the individual Customer operating that program.

3. Consent to receive messages

Recipients receive text messages only after providing consent to the relevant Customer — for example, by submitting a phone number through a form, checking an opt-in box, texting a keyword, or otherwise agreeing to be contacted. Consent to receive messages is not a condition of purchasing any goods or services.

Customers are solely responsible for obtaining and maintaining proper consent from their Recipients in compliance with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, 10DLC/TCR requirements, and other applicable laws and carrier rules.

4. Message frequency

Message frequency varies and depends on your interactions with the Customer you are communicating with. Many messages are conversational (sent in reply to you); others, such as reminders or notifications, are sent as needed. The Customer operating a specific program will disclose its expected message frequency at the point of opt-in.

5. Message & data rates

Message and data rates may apply. Any charges are billed by and payable to your mobile carrier. Please contact your wireless provider for details about your messaging and data plan.

6. Opt-out (STOP)

You can cancel messages at any time by replying STOP to any message. After you send STOP, you will receive one final message confirming that you have been unsubscribed. You will no longer receive messages from that number. To rejoin, reply START or UNSTOP, or opt in again through the Customer.

Opt-out requests are processed automatically on a per-number basis before any further message is sent. MaLuce honors STOP requests regardless of the exact keyword used, consistent with carrier standards.

7. Help (HELP)

For help, reply HELP to any message, or contact the business you are communicating with directly. You may also reach MaLuce at info@maluce.app. A HELP reply will provide support contact information for the applicable messaging program.

8. Carrier liability

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and network availability, and is not guaranteed. Supported carriers may change over time and are not liable under these SMS Terms.

9. Privacy

Your privacy matters to us. Information collected in connection with text messaging is handled as described in our Privacy Policy.

No mobile information (including phone numbers and SMS opt-in data) will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data is used only to deliver and support the messaging service and is shared solely with the service providers necessary to transmit your messages.

10. Customer obligations

Customers using MaLuce to send messages agree to:

  • Obtain and document valid consent from Recipients before sending messages;
  • Honor opt-out requests and refrain from messaging Recipients who have opted out;
  • Clearly identify themselves in messages and provide accurate program, frequency, rate, and opt-out disclosures at the point of opt-in;
  • Comply with the TCPA, CAN-SPAM (where applicable), CTIA Messaging Principles and Best Practices, 10DLC/TCR registration requirements, and all other applicable laws and carrier policies;
  • Refrain from sending prohibited content, including messages related to the SHAFT categories (Sex, Hate, Alcohol, Firearms, Tobacco) where not permitted, and any unlawful, fraudulent, or abusive content; and
  • Indemnify MaLuce against claims arising from the Customer's messaging practices.

MaLuce may suspend or terminate messaging that violates these SMS Terms, applicable law, or carrier requirements.

11. Changes to these terms

We may update these SMS Terms from time to time. When we make material changes, we will update the “Last updated” date above. Your continued use of the messaging features after changes take effect constitutes acceptance of the revised SMS Terms.
