1. Overview

This Privacy Policy explains how MaLuce LLC (“MaLuce,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with the MaLuce platform — a multi-tenant SMS/MMS shared inbox service for businesses, managed service providers, and VoIP resellers — along with our website at maluce.app and related applications and APIs (collectively, the “Services”).

By using the Services, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use the Services.

2. Who we are

MaLuce LLC is an independent company that provides business messaging software. Depending on how you interact with us, MaLuce may act as a data controller (for example, for visitors to our website and for account administrators) or as a data processor acting on behalf of our business customers (for example, for the contacts and message content our customers manage inside their inbox). See Controller & processor roles for details.

3. Information we collect

Information you provide

  • Account & contact details — name, business name, email address, phone number, and role when you create an account, join a waitlist, or contact us.
  • Billing information — billing address and payment details, which are processed by our third-party payment processor. We do not store full card numbers on our systems.
  • Customer content — the messages, contacts, notes, attachments (MMS media), and other data you and your team create or upload while using the shared inbox.
  • Compliance information — details you submit for 10DLC / TCR brand and campaign registration.

Information collected automatically

  • Usage & device data — log data, IP address, browser and device type, pages viewed, and timestamps.
  • Cookies & similar technologies — used to keep you signed in, remember preferences, and understand how the Services are used.

Information from carriers and third parties

  • Message metadata & delivery status from our telecommunications partners (for example, delivery receipts and inbound message routing information).
  • Caller name (CNAM) lookups used to display a name for an inbound number when available.

4. How we use information

We use personal information to:

  • Provide, operate, and maintain the Services, including sending and receiving SMS/MMS on your behalf;
  • Authenticate users and secure accounts;
  • Process payments, manage subscriptions, and administer message credits;
  • Provide customer support and respond to your requests;
  • Support regulatory and carrier compliance, including opt-out (STOP) handling and 10DLC/TCR registration;
  • Monitor, troubleshoot, and improve the Services and develop new features;
  • Detect, prevent, and address fraud, abuse, and security incidents; and
  • Comply with legal obligations and enforce our agreements.

5. SMS/MMS & mobile opt-in data

The MaLuce platform exists to send and receive text messages on behalf of our business customers. When end users exchange messages with a MaLuce customer, we process phone numbers, message content, media, timestamps, and consent (opt-in / opt-out) status in order to deliver the messaging service.

We do not sell your data, and mobile opt-in information is never shared with third parties for their own marketing. No mobile information (including phone numbers and SMS consent) will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared only with the subprocessors listed below strictly to deliver and support the messaging service.

Consumers who receive messages sent through MaLuce can opt out at any time by replying STOP to the message, and can reply HELP for assistance. Opt-out requests are honored on a per-number basis and stop further messages from that number. Message and data rates may apply.

The specific consent language, program description, message frequency, and opt-out instructions applicable to a given messaging program are provided by the individual business (our customer) operating that program.

6. How we share information

We share personal information only as described below:

  • With our customers — customer content is made available to the business account (tenant) that owns it and its authorized users.
  • With service providers & subprocessors — vendors who process data on our behalf to run the Services (see below), under contractual confidentiality and data-protection obligations.
  • For legal reasons — when required by law, subpoena, or other legal process, or to protect the rights, safety, and property of MaLuce, our customers, or others.
  • In a business transfer — in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.

We do not sell personal information, and we do not share mobile opt-in data or phone numbers with third parties for their marketing purposes.

7. Service providers & subprocessors

We rely on trusted third-party service providers to operate the Services, including for categories such as SMS/MMS carrier and message delivery, phone number provisioning, cloud hosting and data storage, payment processing, and real-time message delivery and push notifications. These providers are authorized to use personal information only as necessary to perform services for us, under contractual confidentiality and data-protection obligations.

A current list of our subprocessors is available upon request — contact us using the details in Contact us below.

8. Data retention

We retain personal information for as long as needed to provide the Services, comply with our legal and regulatory obligations, resolve disputes, and enforce our agreements. Customer content is retained for the life of the customer's account and deleted or de-identified within a reasonable period after account termination, except where longer retention is required by law. Certain records (such as audit logs, billing ledgers, and compliance records) are retained on an append-only basis for legal and security purposes.

9. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, tenant-level data isolation, access controls, and secret management through a dedicated key vault. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Your rights & choices

Depending on your location, you may have the right to access, correct, delete, or port your personal information, to object to or restrict certain processing, and to withdraw consent. To exercise these rights, contact us using the details below.

If your personal information is held by MaLuce on behalf of one of our business customers (i.e., we act as a processor), we will refer your request to the relevant customer, who is the controller of that data.

You can control cookies through your browser settings, and you can opt out of receiving text messages from a MaLuce customer by replying STOP.

11. Controller & processor roles

When MaLuce decides how and why personal information is processed — for example, information about our website visitors, account administrators, and billing contacts — we act as a controller.

When our business customers use MaLuce to communicate with their own contacts, those customers determine how the messaging is used, and MaLuce acts as a processor on their behalf. In that case, the customer's own privacy policy governs their use of the data, and this policy describes our practices as their service provider.

12. Children's privacy

The Services are intended for business use and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, please contact us so we can delete it.

13. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised policy.
